The Website is provided strictly on an “AS-IS” and “AS-AVAILABLE” basis. No right of access is guaranteed.

All product descriptions, prices, promotions, and availability are subject to change without notice. We reserve the right to cancel or refuse any order for any reason, including suspected fraud, system error, or unavailability.

We make no representations regarding accuracy, completeness, or suitability of product information.

Vial Case:

6. Disclaimer of Warranties

To the maximum extent permitted by law, Vial Case disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and accessibility.

7. Limitation of Liability

To the fullest extent permitted by law:

  • Vial Case shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or statutory damages

  • Including damages arising from alleged accessibility barriers or inability to access the Website

Total liability, if any, shall not exceed the amount you paid to Vial Case in the twelve (12) months preceding the claim, or $100, whichever is greater.

Nothing in this section limits liability where such limitation is prohibited by law.

You agree to indemnify, defend, and hold harmless Vial Case and its owners, officers, employees, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to:

9. Mandatory Individual Arbitration and Class Action Waiver

This provision shall be interpreted broadly and enforced to the maximum extent permitted by law. If any portion is found unenforceable, the remainder shall remain in effect.

10. Governing Law and Venue

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent any claim is not subject to arbitration, exclusive jurisdiction and venue shall lie in the state or federal courts located in California.

11. Modification and Severability

We may modify these Terms at any time. Continued use of the Website constitutes acceptance of any revised Terms.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
